§ 2.41.040. Acquisition of real property by eminent domain.
Latest version.
The City has the right and power to acquire real property for a public use through
eminent domain. Acquisition of real property through the City's power of eminent domain
must conform to the provisions of the California Eminent Domain Law, California Code
of Civil Procedure Sections 1230.010, et seq., and other applicable state and federal
law provisions. Notwithstanding anything to the contrary in this chapter, acquisition
of real property through the use of the City's power of eminent shall be authorized
by Council adoption of a resolution of necessity pursuant to California Code of Civil
Procedure Section 1245.210, et seq., and shall not require an ordinance.
