  • A lender who, when acting in good faith, fails to comply with this chapter, will not be considered to have violated this chapter if the lender establishes that, within thirty (30) calendar days of the closing of the home loan and prior to the institution of any action under this chapter, the lender has notified the borrower of the compliance failure, the lender has made appropriate restitution, and the lender has adjusted the terms of the home loan in a manner beneficial to the borrower to make the loan comply with this chapter.
