Any person violating any provision of this Chapter shall be punished upon a first
violation by a fine of not more than $1,000.00 and, for a second violation within
a period of one year, by a fine of not more than $2,000.00 and, for a third or any
subsequent violation within a one-year period, by a fine of not more than $5,000.00.
Any violation beyond the third, within a one-year period may be charged by the City
Attorney or the District Attorney as a misdemeanor and the penalty for conviction
of the same shall be punishable by a fine of not more than $10,000.00 or by imprisonment
in the county jail for a period of not more than six (6) months or by both. Any person
violating or failing to comply with any of the provisions of this Chapter shall be
subject to civil penalties and administrative citations per Chapters 1.08 and 1.12 of this Code, and could be subject to confiscation of their merchandise and food
for sale, and/or impoundment of the food vending facility.
