§ 5.04.560. Saving clause.

    The provisions of this chapter shall not apply to any person, association, corporation or to any property, as to whom or which it is beyond the power of the City Council to impose the business tax herein provided. If any sentence, clause, section or part of this chapter, or any business tax against any individual or any of the several groups specified herein is found to be unconstitutional, illegal or invalid, such unconstitutionality, illegality or invalidity shall affect only such clause, sentence, section or part of this chapter and shall not affect or impair any of the remaining provisions, sentences, clauses, sections or other parts of this chapter. It is declared to be the intention of the City Council of the city that this would have been adopted had such unconstitutional, illegal or invalid sentence, clause, section or part thereof not been included herein.

    B.

    Any person claiming an exemption from the business tax imposed by this chapter by virtue of this section, shall submit to the Business Tax Section a statement signed under penalty of perjury setting forth the facts necessary to establish such claim of exemption.
